Definitions
In these General Terms and Conditions, the following terms are used in the following sense, unless explicitly stated otherwise.
Organiser: The party that offers, advertises and/or sells the Activity and is liable for the organised Activity.
Activity: the travel products, tours and/or travel services offered, advertised and/or sold by the Organiser.
Customer: the person who books an Activity with an Organiser on CitySpotters.
Agreement: Any agreement between the Customer and the Organiser regarding the offered Activity on CitySpotters.
Confirmation: the digital confirmation of the Agreement between the Organiser and the Customer for participation in the Activity. The Confirmation is provided to the Customer by CitySpotters on behalf of the Organiser.
CitySpotters: the online marketplace www.cityspotters.com, part of GoNomadic B.V.. CitySpotters does not (re)sell, organise and/or offer travel products, travel activities and/or tours.
These terms and conditions
The terms and conditions of CitySpotters and the terms and conditions of the Organiser apply to any Agreement. When making a booking for an Activity, the Customer may consult the terms and conditions of CitySpotters and the terms and conditions of the Organiser. By making the booking, the Customer agrees to the terms and conditions of CitySpotters and the Organiser.
The role of CitySpotters
CitySpotters is an online marketplace where Organisers of Activities are given the opportunity to list, advertise and sell Activities. Visitors of CitySpotters can book these Activities directly with the Organiser on CitySpotters. A direct (purchase) Agreement is established between the Customer and the Activity Organiser when the Customer makes a booking for an Activity on CitySpotters. On behalf of the Organiser, CitySpotters will send the Customer a confirmation of the Agreement in the form of a digital confirmation email. CitySpotters does not (re)sell, organize and/or offer travel products, travel activities and/or tours.
Operation of the Activity
The Organiser of the Activity is responsible and liable for the operation and the performance of the Activity offered by the Organiser on CitySpotters. CitySpotters informs the Customer of the Organiser of the Activity for each Activity.
Availability and content of the Activity
Each Activity on CitySpotters is without obligation and subject to availability. CitySpotters is not liable for any inaccuracies in the availability and content of the Activity as listed and sold by the Organiser on CitySpotters.
The Organiser has the right to change the content, itinerary and availability of the Activity at any time, if deemed necessary due to unforeseen circumstances.
Cancellations and no-shows
For the cancellation of an Agreement, the general terms and conditions of the Organiser are leading at all times.
Online payment
For certain Activities CitySpotters processes the full payment amount of the Agreement online on behalf of the Organiser. The Organiser authorised CitySpotters to process the payment on behalf of the Organiser. The online payment is facilitated by a secure and reliable third party.
If any payment from the Customer is incomplete, revoked or unsuccessful then the Agreement will be cancelled and the Customer will not be entitled to participate in the Activity.
Prices and exchange rates
Where a currency other than the Organisers' currency is used to calculate the price of an Activity for the Customer, CitySpotters will show an estimate of the converted amount in the Customers' relevant currency. CitySpotters will use a third party to convert the currency, using the most recent exchange rate possible. CitySpotters is not liable for inaccuracies in the price display of the currency as displayed in an Activity listed on CitySpotters. The Customer will be informed of the total price of the chosen Activity in the relevant currency when making a booking.
VAT
The Organiser is responsible for correctly informing the Customer of which part of the total price may be designated as VAT (taxes) in the relevant country of the Organisers' residence. Invoice of Agreement
When the Customer wishes to receive an invoice for the Agreement, the Customer may contact the Organiser for this. The Confirmation received by the Customer is not valid as an invoice. Due to the Customer having entered a direct Agreement with the Organiser, the Organiser is obliged to send the Customer an invoice. The Customer will never receive an invoice on behalf of CitySpotters, the Customer has no agreement with CitySpotters.
Reviews
The Customer has the right to post a review with his/her opinion on the Activity participated in, with the aim of informing (future) customers about their experience of the Activity.
CitySpotters has the right to remove a review of the Customer without notice if CitySpotters believes that the review does not sufficiently represent an opinion of a Customer who has successfully participated in the Reviewed Activity.
CitySpotters has the right to change an assessment of the Customer without notice for spelling errors, typos, language errors and errors caused by the auto-correction functionality.
CitySpotters has the right to use the content of a review and the associated username as displayed in the review for various promotional purposes without notice to the Customer.
Complaints
The Organiser of the Activity is responsible for handling complaints from Customers who have participated in an Activity in which the Agreement was formed on CitySpotters. CitySpotters is not responsible for dealing with these complaints, but may decide to assist the Customer and/or the Organiser in dealing with them when requested to do so.
Liability
CitySpotters is not liable for damages and costs incurred by the Customer as a result of the Organisers' actions and/or participation in the Activity.
CitySpotters cannot be held liable for inaccuracies in the Agreement or the Activity as described on CitySpotters.
All legal relationships to which CitySpotters is a party shall be governed exclusively by the laws of the Netherlands, even if an obligation is performed in whole or in part abroad or if the party involved in the legal relationship is domiciled there.
